New T2 Regulations Webinar Available on Demand

On Tuesday, May 22, 2018, the FLC held the “New T2 Regulations: What You Need to Know” webinar hosted by Dr. Courtney Silverthorn, Deputy Director, Technology Partnerships Office, National Institute of Standards and Technology (NIST). The webinar was designed to inform federal technology transfer (T2) professionals of the new regulations that NIST recently released for complying with the Stevenson-Wydler and Bayh-Dole acts.

The new T2 regulations were officially released on April 13, 2018, following two years of reviews, revisions, and finalizing necessary changes. The goals of the Bayh-Dole revisions were to update:

  • America Invents Act timelines, definitions, and royalty payment requirements that conflicted with regulatory provisions in Bayh-Dole
  • Certain scenarios (provisional applications, joint intellectual property, CRADA background licenses) that had not been contemplated in the original Bayh-Dole Act
  • Codification of EO 12591 in regulation.

Throughout the webinar, Dr. Silverthorn, who played an essential role in crafting the new rules, updates T2 offices on the changes they need to know and how they will affect their work. Changes discussed include:

  • Licensing CRADA background inventions
  • Priority order changes for joint inventions.
