Authority

  • AFI Directive 61-3, AFI Instruction 61-302, and 10 USC 2371(a)

Description

  • A Cooperative Research and Development Agreement (CRADA) is a formal agreement between private industry and the Air Force. It can involve one or more federal laboratories and one or more nonfederal parties.

The federal lab may provide personnel, services, facilities, and equipment, but no funds.

The non-federal party may provide funds, personnel, services, facilities, and equipment.

Features/Characteristics

  • The CRADA provides for the protection of company proprietary information.

Certain data resulting from the work can be protected for up to five years under FOIA , 5 USC 552 et. seq.

CRADA is not considered a procurement contract, grant, or cooperative agreement; therefore, it is not subject to 31 USC 6303-6305 terms.

Preference is given to businesses located in the United States, which agree that those products embodying inventions made under CRADAs will be substantially manufactured in the United States.

I.P. and Resource Commitment

  • Rights to inventions and other intellectual property are negotiated as part of the agreement.

The CRADA guarantees to the non-federal party a nonexclusive, paid-up, royalty-free license to any patents that are derived from the CRADA research.
